| 摘 要： | 我国城镇化建设过程中出现滥征农民土地、强制农民拆迁的现象,从法治角度分析,原因在于相关法律缺失,在实际操作中轻法律规范重规章政策、轻私权重公权、轻农村重城市,不合时宜地运用"特别牺牲"理论,忽视农民的合法权益.有必要建立和完善相关法律,确立"充分、及时有效的补偿"原则,制定统一的补偿计算标准及安置原则,明确界定"公共利益",加强司法审查.

| Abstract: | In the process of urbanized construction in China, farmers' land is often mis-confiscated and the farmers are compelled to move to other areas. From the perspective of law, this may attribute to the lack of corresponding laws and regulations, and to the neglect of farmers' legal rights and benefits. Thus, this paper suggests that it is necessary to constitute and perfect corresponding laws and regulations, formulate the principle of "sufficient, timely and valid compensation", define a unified compensation standard and aftercare principle, make clear "public benefits", and strengthen judicial inspection. |
