| [ 目的 / 意义 ] 现有文献没有全面梳理美国商业方法上百年来的发展趋势。本文通过展现涉及商业方法的判例在不同时期被建立、取代和变更的历程，反映美国司法实践的发展以及商业方法审查政策的曲折变化历程。[ 方法 / 过程 ] 就商业方法是否是适格客体而言，美国社会各界充满争论，相关司法判决和美国专利商标局（USPTO）的审查标准也一直左右摇摆。本文基于美国商业方法专利的定义，以美国商业方法的历年申请量为样本，着重从判例和审查政策两个方面，按时间线全面整理分析商业方法专利在美国的发展历程。[ 结果 / 结论 ] 美国商业方法上百年来的发展历程，证明了专利政策与产业发展阶段和维持竞争优势紧密相关。 |

| [Objective/Significance] The existing literatures do not comprehensively sort out the development trend of business method in the past period. By showing the history of the establishment, substitution and change of the cases related to business method in different periods, it reflects the development of American judicial practice and the tortuous change of business method policy. [Methods/Process] As for whether business method is patentable, American society is full of controversy, and the relevant judicial decisions and USPTO's examination standards have been swaying. According to the definition of business method of USPTO, taking the number of applications over the years as a sample, focusing on both the case and the policy, this paper gives
a fully comprehensive analysis of the development of business method of USPTO based on the time line.[Results/Conclusions] The development history of business method in the past period proves that patent policy is closely related to the development stage of the industry and maintaining competitive advantage. |
